Terms of Use

These Terms of Use (the “Terms”) govern access to and use of the repairexplainer.com website, personalized repair explanations, secure links, repair-status experiences, communications, and related customer-facing services operated by Hero Group LLC, doing business as Repair Explainer (“Repair Explainer,” “we,” “us,” or “our”).

By accessing or using the website, opening a personalized Repair Explainer after being presented with a conspicuous link to these Terms, or otherwise affirmatively continuing after notice of these Terms, you acknowledge and agree to these Terms to the extent permitted by law. If you do not agree, do not use the services.

A participating repair facility may send you a Repair Explainer through a secure link, email, or text message. The repair facility remains responsible for its repair relationship with you and for the information it provides through Repair Explainer.

Repair Explainer is an assumed name of Hero Group LLC and is not a separate legal entity. Certain Repair Explainer functions may be provided through systems or services supplied by Reclaimr LLC, an affiliated company.

Body shops cannot purchase a Repair Explainer subscription directly through the Repair Explainer website. Shop inquiries may be shared with or redirected to Reclaimr LLC. Any commercial relationship between a repair facility and Reclaimr is governed by separate Reclaimr agreements.

Repair Explainer provides technology on behalf of participating repair facilities. The repair facility, not Repair Explainer, controls the underlying estimate, repair plan, repair-status information, pricing, approvals, repair work, completion timing, final invoice, and customer relationship.

Repair Explainer may present a plain-language explanation of information contained in a repair estimate, supplement, repair order, shop record, or related communication. It may include vehicle information, repair operations, prices, diagrams, insurer information, repair-status milestones, estimated dates, and explanations supplied or approved by the participating repair facility.

Repair Explainer may also provide secure links, email or SMS delivery, customer communication tools, future repair timelines, milestone tracking, approval requests, delay notices, appointment information, and pickup-related updates.

A Repair Explainer is an informational and communications tool. It is not the official estimate, repair order, supplement, invoice, final repair record, independent inspection, engineering analysis, repair certification, legal advice, insurance advice, claims representation, or guarantee of insurance coverage or payment.

Information may be incomplete, simplified, generated or assisted by automated tools, or based on information available at a particular stage of the repair. Repair needs, procedures, parts, prices, insurer positions, and timing may change after disassembly, inspection, supplemental estimating, manufacturer-procedure research, parts review, insurer review, or discovery of additional damage.

Contact the participating repair facility for official documents, vehicle-specific decisions, repair questions, charges, approvals, and status information.

The participating repair facility is solely responsible for the accuracy, completeness, and appropriateness of the repair information, statements, recommendations, commitments, and status updates it provides or approves through Repair Explainer.

Repair Explainer does not supervise, inspect, direct, approve, warrant, or certify repairs. We are not responsible for repair quality, repair completeness, vehicle safety, compliance with manufacturer procedures, insurer decisions, customer charges, delays, or pickup readiness.

Repair stages, milestones, estimated dates, and claim-progress information are informational and may change. Delays may result from hidden damage, parts availability, insurer decisions, approvals, scheduling, quality-control requirements, vendor availability, or other circumstances.

A displayed milestone does not independently establish that a repair operation has been completed, inspected, approved, paid for, or documented. Do not travel to the repair facility or attempt to retrieve a vehicle until the repair facility directly confirms that the vehicle is ready.

Personalized Repair Explainers may be made available through unique or private links. A link may not require a separate password, and anyone who obtains a valid link may be able to view the information available through it.

You should not forward, publish, or disclose a personalized link unless you are authorized to do so. If you receive a link in error, stop using it and contact the participating repair facility or Repair Explainer.

We may expire, revoke, restrict, or disable a link at any time for security, privacy, legal, operational, or customer-support reasons. We do not guarantee that a link will remain available indefinitely.

A participating repair facility may use Repair Explainer to send repair-related messages by email or text message. These messages may include a Repair Explainer link, estimate explanation, approval request, appointment information, repair-status update, delay notice, or pickup communication.

Text messages are subject to the Repair Explainer SMS Terms. Message and data rates may apply. You may opt out of applicable text messages by replying STOP or using another reasonable method described in the SMS Terms.

Delivery is not guaranteed. Carriers, email providers, spam filters, invalid contact information, device settings, and third-party outages may delay, block, or prevent delivery.

If you submit a body shop inquiry through the Repair Explainer website, Repair Explainer may use the information to respond and may share it with Reclaimr LLC so Reclaimr can discuss access to Repair Explainer or related services.

Submitting an inquiry does not create a subscription, customer relationship, or obligation to purchase any service.

• Do not access another person’s Repair Explainer without authorization.
• Do not scrape, crawl, harvest, copy, republish, resell, reverse engineer, interfere with, or attempt to bypass security controls associated with the services.
• Do not use the services to violate privacy, intellectual-property, consumer-protection, communications, insurance, or other laws.
• Do not introduce malicious code, attempt unauthorized access, or disrupt the availability or security of the services.
• Do not misrepresent Repair Explainer content as an official inspection, certification, legal opinion, insurance determination, or guaranteed completion date.

Repair Explainer and its licensors own the website, software, designs, interfaces, templates, explanatory formats, graphics, workflows, and other intellectual property used to provide the services. These Terms grant only a limited, revocable, non-transferable right to access and use the services for their intended purpose.

Repair facilities and other content providers retain their rights in content they submit, subject to the rights needed for Repair Explainer and its service providers to host, process, display, transmit, secure, and support that content.

The services may rely on or link to third-party systems, repair facilities, insurers, communications providers, mapping services, analytics tools, or other websites. We do not control and are not responsible for third-party services, content, availability, security, or privacy practices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. REPAIR EXPLAINER DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND QUIET ENJOYMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ANY EXPLANATION, DIAGRAM, PRICE, REPAIR OPERATION, INSURER DESCRIPTION, STATUS, MILESTONE, ESTIMATED DATE, MESSAGE, OR LINK WILL BE COMPLETE, CORRECT, CURRENT, DELIVERED, AVAILABLE, ACCEPTED BY AN INSURER, OR SUITABLE FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERO GROUP LLC, REPAIR EXPLAINER, RECLAIMR LLC, THEIR AFFILIATES, AND THEIR RESPECTIVE PERSONNEL, LICENSORS, VENDORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, VEHICLE VALUE, CLAIM VALUE, BUSINESS OPPORTUNITY, OR CUSTOMER RELATIONSHIP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), EXCEPT TO THE EXTENT A DIFFERENT LIMIT IS REQUIRED BY LAW. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, OR TO FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION.

You agree to indemnify and hold harmless Hero Group LLC, Repair Explainer, Reclaimr LLC, their affiliates, and their personnel and service providers from third-party claims, losses, liabilities, and reasonable expenses arising directly from your intentional or unlawful misuse of the services, deliberate unauthorized disclosure or republication of another person’s personalized link or repair information, malicious interference with the services, or knowing violation of another person’s rights. This obligation does not apply to ordinary, accidental use of a Repair Explainer.

We may restrict, suspend, or terminate access to the services or a personalized link when reasonably necessary to address security, privacy, legal, operational, misuse, or third-party- provider concerns.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute not subject to a legally required alternative process will be brought in a state or federal court located in Travis County, Texas, and each party consents to that jurisdiction and venue.

Nothing in this section limits either party’s ability to seek emergency injunctive or equitable relief in a court of competent jurisdiction.

You consent to receive notices and records relating to these Terms and the services electronically, including through the website, a Repair Explainer page, email, or text message, where permitted by law.

These Terms constitute the entire agreement between you and Repair Explainer regarding your use of the public website and customer-facing Repair Explainer services, except that separate agreements may govern your relationship with a participating repair facility or Reclaimr LLC.

f any provision is held unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, financing, restructuring, or sale of all or part of the business.

We may update these Terms from time to time. The updated Terms become effective when posted or on the stated effective date. Continued use after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
